STANDARD OF REVIEW FOR PROSECUTORIAL USE OF RACE EVIDENCE DURING TRIAL

The author warns that use of cultural evidence by prosecutors must be held to a higher standard of review. He feels that this stricter standard is necessary because it is more difficult to estimate its effect on jurors.
