STANDARD OF REVIEW FOR PROSECUTORIAL USE OF RACE EVIDENCE DURING TRIAL
This note by Peter Chung is in University of Michigan Journal of Law Reform, v.38, no.1, 2004. The author warns that use of cultural evidence by prosecutors must be held to a higher standard of review. He feels that this stricter standard is necessary because it is more difficult to estimate its effect on jurors.
